FirstTouch Sales — Terms

Who we are

FirstTouch Sales is run by Pretiosus, Kochi, India. These terms are an agreement between Pretiosus and the business that uses FirstTouch Sales ("you"). By creating an account or using FirstTouch Sales, you accept them. If you accept them for a business, you confirm you are allowed to do so.

What FirstTouch Sales does

FirstTouch Sales helps your team keep track of the companies and people you sell to: contacts, enquiries, deals, tasks, and the messages you send and receive. You can connect a Microsoft 365 mailbox so that enquiries arrive in FirstTouch Sales, and add your own Anthropic API key to use the AI buttons. FirstTouch Sales is not affiliated with, endorsed by or sponsored by Microsoft or Anthropic.

Your account and your team

• Keep your business details accurate and your logins safe.
• You are responsible for everyone you add to your workspace.
• Tell us straight away if you think someone has used your account without permission.
• Only connect a mailbox you are allowed to connect.
• You need a lawful reason to keep and use the information about the people in your contacts.

Fair use

You are responsible for the messages your team sends, and for following the law where you and the people you contact are, including the rules on unwanted messages and on personal information. Do not use FirstTouch Sales to:

• send spam or bulk unwanted messages;
• use contact details obtained unlawfully;
• do anything unlawful;
• get around FirstTouch Sales', Microsoft's or Anthropic's limits;
• resell or share FirstTouch Sales with others without our written agreement.

We may suspend or end access if these terms are broken, if there is a security or legal risk, or if the law requires it.

The AI buttons

When someone in your workspace clicks an AI button (qualify, draft or refine), the relevant contact and message text is sent to Anthropic using your workspace's own key, under your own agreement with Anthropic. AI suggestions can be wrong, so a person in your team should check every draft. Nothing is sent automatically: an email goes out only when a person clicks Send.

Your data

Your business owns its data. We use it only to run FirstTouch Sales for you, as our privacy page explains. For a copy of your data, or to delete it, email office@pretiosus.cc.

Fees

Fees are set in a written agreement with you. Taxes are extra.

Availability

We work to keep FirstTouch Sales running, but we cannot promise it will never be interrupted, unless we have agreed a service level with you in writing. It depends on services run by others, such as Microsoft 365, and we cannot guarantee that every email arrives or is sent. FirstTouch Sales is provided as it is, as far as the law allows.

Limits on liability

We are not liable for indirect or consequential losses. Our total liability is limited to the fees you paid in the 12 months before the event that led to the claim. Nothing here limits liability that the law does not allow us to limit, including for fraud.

You will cover our costs from claims caused by your breach of these terms, by unlawful use of FirstTouch Sales, or by unlawful handling of personal information.

Ending

Either side can end the agreement as agreed in writing, or, if nothing was agreed, with reasonable written notice. Your data is then handled as our privacy page explains.

Changes

We will email you about important changes before they take effect, and update this page and its date. Using FirstTouch Sales after that means you accept them.

Law

These terms are governed by the laws of India. The courts at Ernakulam, Kerala have jurisdiction, subject to any rights you have by law to go to court elsewhere.
